An FBI agent testified Thursday that phone records show the defendants in the State House vote-buying case talked the same day prosecutors allege a bribe offer was made to a state senator who was wearing a wire.

FBI Special Agent Nathan Langmack testified that, during the 2010 legislative session, there was an average of four calls per day between phones associated with VictoryLand owner Milton McGregor and Country Crossing developer Ronnie Gilley.

Two of those calls came on Feb. 18, 2010, the day that Gilley testified he and McGregor met with Sen. Scott Beason, R-Gardendale, to try to bribe him for his vote on gambling legislation.

Prosecutors introduced the phone records to corroborate the testimony of Gilley, who said he worked closely with McGregor to bribe key lawmakers for their votes on a gambling bill. But defense lawyers said the toll records are meaningless, since it is unknown what was said on the calls.

McGregor; Sen. Harri Anne Smith, I-Slocomb; lobbyist Tom Coker; casino spokesman Jay Walker; and former state Sens. Jim Preuitt, R-Talladega, and Larry Means, D-Attalla, are accused of offering or accepting bribes in connection with 2010 gambling legislation.

Langmack also testified that there were several calls between Gilley and Smith on the same day in early March that Gilley has testified he waited at a Zaxby’s restaurant for Smith to arrange a meeting with Beason. Langmack said that records indicated Gilley called McGregor that evening, as Gilley testified he did.

But McGregor lawyer Ben Espy suggested the number of calls were meaningless since it is not known what was said on the calls.

Espy also pointed out that calls with Gilley accounted for only about 4 percent of the calls McGregor took and made during the 2010 legislative session. He said that was “a very small number,” Espy said.

The bill at the center of the case was aimed at sheltering McGregor’s and Gilley’s casinos from state efforts to shut them down. The proposal, if approved by lawmakers and voters, would have written into the Alabama Constitution that the electronic bingo machines were legal.

Other testimony Thursday focused on payments McGregor made to legislative employee Ray Crosby, who was in charge of drafting the bill. Crosby was a defendant in the case but was found dead of natural causes in his home last month.

McGregor bookkeeper Lynn Byrd testified that McGregor began paying legislative bill writer Ray Crosby $3,000 a month in spring 2008. Byrd said she didn’t know what Crosby did for McGregor.

“I thought that he might be a lobbyist,” Byrd testified.

The first check was written May 5, 2008, and the checks were issued monthly for two years.

McGregor’s last check to Crosby was sent April 7, 2010. McGregor told Byrd to stop sending the payments.

Prosecutors have accused McGregor of paying Crosby $72,000 to watch out for his interests as he drafted gambling bills. But McGregor’s defense contends Crosby was being paid for outside consulting work.

Langmack testified that federal wiretaps picked up about two dozen calls between McGregor and Crosby in March 2010, and they never discussed anything but the legislation.
